1. Formation of the contract
1.1 These terms of sale apply to all goods supplied by Heathbold.
1.2 No contract exists between you and us for the sale of any goods until we have received your payment and order, and a confirmation of that order has been communicated to you. Once this confirmation has been communicated to you, there is a binding legal contract between us.
1.3 The contract is subject to your right of cancellation (see Para 5 below).
1.4 We may change these terms and conditions of sale without notice to you in relation to future sales.
1.5 Orders placed fraudulently; or via unauthorised access to the Heathbold online shop; or through the misuse of discount codes, will be invalid.
2. Description and price of goods
2.1 The description and price of the goods you order will be as shown on our website at www.heathbold.co.uk or on our various internet shop fronts including Ebay, Etsy and others, at the time you place your order.
2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you by email as soon as possible, and offer you to choose between an alternative product, or a refund, or a credit note for any sum that has been paid by you or debited from your credit card for the goods and/or services.
2.3 Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will offer you to choose between a refund or a credit note for any sum that has been paid by you or debited from your credit card for the goods and/or services.
2.4 Most Heathbold bags are delivered within the UK free of charge. Ancillary and small goods may incur a delivery charge, and this will be clearly stated prior to the completion of any order.
2.5 The price of the goods and delivery charges are full and final and not negotiable. Heathbold is a private business not registered for VAT purposes.
2.6 The prices on this website and other shop fronts are prices relevant to UK consumers.
3.1 Currently, Heathbold accept card payments via Paypal. This policy is subject to on-going revision, and payments can be made by any method shown on our website at the time you place your order. At the moment we do not accept cash or cheque payments.
4.1 We will always try to package and send you goods within 24 hours of receiving you order and payment. We currently use a range of professional couriers, primarily Royal Mail, who offer delivery within 1-2 days.
4.2 The goods you order will be delivered at the address you give when you place your order.
4.3 All deliveries UK or worldwide require a signature.
4.4 If delivery cannot be made at your address, we will inform you as soon as possible.
4.5 Every effort will be made to deliver the goods as soon as possible after your order has been accepted, and in any event within 30 days of your order. However, we will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this case, we will inform you as soon as possible.
4.6 You will become the owner of the goods you ordered, and responsible for risk of loss of or damage to them, as soon as they have been delivered to your chosen delivery address.
5. Your right of cancellation
5.1 You have 14 days to change your mind and return your un-personalised, un-engraved purchase for a full refund. You do not need to provide Heathbold with a reason for cancelling – if you change your mind about your purchase for any reason, we will give you your money back. Further, you can withdraw from this contract at any time prior to Heathbold dispatching your purchase, with no penalty to you.
5.2 If you change your mind after goods have been dispatched, you will be liable for all return delivery costs. You have the right (subject to paragraph 5.4) to cancel the contract at any time up to the end of 14 days after the day on which you place your order. Your contract commences once you have placed your order, made your payment, and been notified by Heathbold of confirmation of your order. These rights do not apply to personalised, customised or engraved goods, or to goods delivered outside of the UK.
5.3 To exercise your right of cancellation, you must give written notice to us, either by post at the address shown below, or preferably by email at firstname.lastname@example.org. Please give details of the goods ordered, the date of order, any order references, and where and when goods were delivered. For your convenience, you may want to print and use the following standard cancellation form:

5.4 At Heathbold, we want you to enjoy your purchase, and we are happy for you to properly try out your bag. Please feel free to remove tags and use your Heathbold bag freely as you wish. This type of usage will not effect your rights to cancel. All we ask is that you don’t cause any damage or obvious signs of use to your bag; and that you cover the cost of returning your purchase to us. We recommend that in all cases, you use an insured and tracked courier service. Please be aware that you remain responsible for your goods until they are received by Heathbold. Please ensure that you have paid the correct postage fee, as Heathbold may deduct any postage underpayment from any refunds payable. If you exercise your right to cancel after the goods have been delivered to you, you will be responsible for returning the goods to us at your own cost in the original packaging, with all accessories, and in a re-sellable condition. These extended rights do not apply to graded stock. Personalised, customised or engraved goods are exempt from these cancellation rights.
5.5 Cancelled purchases must be returned to the address shown below. Refunds are required by law to be completed within 14 days. At Heathbold, we are committed to completing this process within 3 days of receiving goods back. Please take reasonable care to ensure the goods are not damaged while you have them or while they are in transit.
5.6 The Heathbold cancellation / returns policy applies to UK sales only. Heathbold will work positively with overseas customers who wish to return goods. In all cases where Heathbold agree to the return of goods delivered outside of the UK, we will deduct our own incurred delivery costs.
5.7 Once you have notified us that you are cancelling the contract and we have received the returned goods, we will refund or re-credit you only by the original payment method. We are not able to issue refunds using alternative payment methods, or by cash or cheque.
5.8 Personalised, customised or engraved goods are exempt from all cancellation rights. Once an item has been personalised, customised or engraved, regardless of whether the item has been dispatched, Heathbold cannot accept any cancellations or issue refunds.
6.1 All goods supplied by us are extensively and individually checked, and are warranted to be free from defects on the date you receive them. Goods shipped within the UK are guaranteed for 12 months from the date of order/payment. Defective goods returned to Heathbold within 1 month of order/payment will be replaced or refunded in full, in line with our no quibble 14 day returns policy. Defective goods returned after the first month, and within the warranty period, will be handled sympathetically on a case by case basis. This will ordinarily involve the offer of a replacement, a credit note, or a repair. This warranty does not apply to graded stock. 6.2 The warranty contained in paragraph 6.1 does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by us, failure to follow our instructions, or any alteration or repair carried out without our approval. Defective goods must be returned to Heathbold before any refund, credit or exchange is authorised.
6.3 If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods and/or services, you should notify us in writing at the address or email address shown below.
6.4 In common with most high quality oiled leather products, new Heathbold bags can sometimes cause transference of organic oils, and staining can occur. This is a temporary process which will cease after a period of use. Our customers are notified of this potential risk before making their purchase, and the packaging of all of our bags is labelled with this information. Owners/users should take care to exercise caution whenever using their bag during hot or wet/humid conditions. This process is not regarded as a product defect, and Heathbold accept no liability for any damage caused to clothing, wall or floor coverings, or any other surfaces as a result of this transference.
6.5 These warranty terms and conditions apply to UK sales of non-customised goods only. Returns of defective goods arranged within the 12 month warranty period must be delivered to Heathbold via courier at your cost. Heathbold will usually return repaired or replaced bags to a UK address free of charge; however Heathbold reserve the right to charge reasonable shipping fees in relation to warranty claims. Warranty claims from outside of the UK will be rejected.
7. Data protection / Privacy / GDPR / Cookies
7.1 Heathbold are committed to protecting your rights to privacy. We take steps to ensure that your data is safe, and we undertake not to sell or misuse your data in any way.
7.2 You provide Heathbold with the following information during the order process: your name, email address, contact telephone number, delivery address, payment information, and details of the product you’re ordering, including engraving and customisation instructions.
7.3 Heathbold relies on this information primarily to fulfil your order, but also to settle disputes; provide support; comply with our obligations in connection with any legal claim; and for the purpose of the legitimate interests of Heathbold so long as these legitimate interests are not overridden by your rights or interests.
7.4 Heathbold do not allow access to your data to third parties other than our couriers; our payment service providers including Paypal; and our web hosts and associated service providers, including Google analytics. Heathbold may grant access to secure areas of its shop and website to third party contractors for maintenance purposes. Such third parties will not be granted access to your data unless it is necessary for maintenance purposes. Your data may be passed to a third party in the event that ownership of Heathbold is sold or transferred. Heathbold may collect, use, retain, and share your information if it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of customers, or others.
7.5 Heathbold will retain your personal information only for as long as necessary to provide you with services. Heathbold may be required to retain this information to comply with legal and regulatory obligations, to resolve disputes, and to enforce agreements. Heathbold will generally keep your emails and other contact data for one year; your transaction data for one year; and any analytics data for one year.
7.6 Heathbold may store and process your information through third-party hosting services outside of the UK. Heathbold may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction.
7.7. You may have the right to receive a copy of any personal information Heathbold held about you. You may have the right to change, restrict the use of, or delete your personal information. Heathbold will usually delete your personal information upon request. You can object to the processing of some of your information based on legitimate interests, or receiving marketing messages, after providing your express consent to receive them. In such cases, Heathbold will delete your personal information unless there are compelling and legitimate grounds to continue using that information or if it is needed for legal reasons. If you reside in the EU and wish to raise a concern about the use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

7.10 We use encrypted passwords and two-factor authentication to protect our servers and your data. Our passwords are changed regularly and all Heathbold staff are properly trained and technically competent. We do not permit the setting up of customer accounts, and we do not store any payment information such as card details. Any data breaches will be reported to affected customers by email immediately on discovery by Heathbold.
8.1 Heathbold are determined to please our customers. If you have a complaint about any aspect of our business, please contact us by email at Heathbold Complaints as soon as possible. We will try to resolve any complaints as a matter of urgency. If goods arrive damaged or are faulty please follow the procedure set out in Para 6.
8.2 We will do everything we can to resolve any issues with our customers. However, in the event of a dispute which cannot be settled, our customers have the right to seek alternative Online Dispute Resolution (ODR). Click here to access the ODR platform website (UK and EU residents only)
9. Applicable law
9.1 These terms and conditions of sale and the supply of the goods will be subject to English and Welsh law, and the English and Welsh and other UK courts will have jurisdiction in respect of any dispute arising from your contract, which is agreed with J. Craig t/a Heathbold, 141 Ribbleton Avenue, Preston, Lancashire. Your rights as a consumer are primarily protected by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; the Consumer Protection from Unfair Trading Regulations 2008; and by the Consumer Rights Act 2015, as well as by other consumer statutes. If you are unsure of your rights, please contact the Citizens Advice consumer helpline for advice. The rights of all copyright holders is acknowledged. All brand names, logos, trademarks and company names shown on this website are acknowledged as being the property of their respective holders or owners, including Heathbold.
10. The environment
10.1 At Heathbold, we take sustainability and all other environmental concerns extremely seriously. We try wherever possible to minimise the use of excessive treatments in our products. We don’t over-pack our goods, and we only use recycled cardboard in our delivery cartons. We can all do more, but we promise to try our hardest to be eco-friendly and to minimise our carbon footprint whenever possible.
